Remand is the temporary detention of a person while awaiting trial, sentencing or the commencement of a custodial disposition. The analysis looks at the number of adults and youth on remand, the number of admissions of adults and youth to remand and the length of time spent on remand. The characteristics of those on remand, including age, gender and Aboriginal identity, are also analysed.

The article uses data from the Youth Custody and Community Services (YCCS) Survey and the Integrated Correctional Services Survey (ICSS) to analyze trends in admissions to and releases from sentenced custody, remand (pre-trial detention) and probation. These data are examined based on key case characteristics such as age, sex, most serious offence and length of time served. Focused analysis of Aboriginal youth includes comparisons with non-Aboriginal youth in the following areas: incarceration rates as of Census Day 2006 for jurisdictions that provided detailed data (i.e., Newfoundland and Labrador and New Brunswick combined, Ontario and Alberta); length of time spent in custody and offence types.

This report provides an overview of issues on mental health and the criminal justice system, as well as the feasibility of collecting data on individuals with mental illness in the criminal justice system. While there have been pockets of studies and data collection activities trying to quantify the issue at the police, courts and corrections levels, there is presently a lack of data to understand the extent of the problem to inform decision-making regarding policy and action, and to measure outcomes of current initiatives and processes.
The first part of the report describes issues with regard to mental illness and the criminal justice system, including definitional challenges, criminal justice system processes, previous studies on the prevalence of individuals with mental illness in the criminal justice system, and the relationship between individuals with mental illness and criminal justice involvement.
The second part presents the results from consultations with over 100 stakeholders, including law enforcement, courts, Review Boards, correctional services, mental health organizations, academics and researchers and non-governmental organizations. It also proposes options for collecting data on persons with mental health issues in the criminal justice system.

This Juristat provides an overview of young persons under correctional services and is the first release of the Youth Custody and Community Services Survey (YCCS) since the implementation of the Youth Criminal Justice Act (YCJA), which came into effect on April 1, 2003. Correctional services include pre-trial detention (remand), secure and open custody, and probation, as well as the new YCJA sentencing options, including, deferred custody and supervision, community portion of a custody sentence (CPCS), and the intensive support and supervision program (ISSP).

Provincial and territorial governments are responsible for the administration of community-based correctional services in Canada for adults and youth, which include, but are not limited to probation, conditional sentences, and temporary absence programs. Although the Criminal Code of Canada, the Young Offenders Act and the Youth Criminal Justice Act set out guidelines, jurisdictions are not obliged to follow them directly. Jurisdictions will differ, sometimes substantially, in their administration.
This publication provides a descriptive overview of sentences and the delivery of community correctional services across all jurisdictions in Canada for both adult and youth. In addition, this publication reports on community corrections data collected from the special study, as well as data from the Adult Correctional Services Survey, the Key Indicator Report, the Youth Custody and Community Services Survey, and the Alternative Measures Survey. It examines admissions and average counts of adults and youth who were under community supervision, showing trends as far back as 1993/94. Furthermore, data on offender characteristics, such as sex and Aboriginal status are also presented.
