The offence of obtaining sexual services for consideration from a minor was reclassified by the Protection of Communities and Exploited Persons Act (PCEPA) as “crimes against the person” in the Criminal Code. In addition, the PCEPA created the new offence of obtaining sexual services for consideration from an adult.

The PCEPA changed the Criminal Code with respect to these offences and they were reclassified as “crimes against the person” in the Criminal Code. In particular, the laws governing receiving material benefit (living on the avails) no longer apply to persons receiving benefit from the provision of their own sexual services or where the benefit is in the context of a legitimate family or business relationship (ex. family members, landlords, etc.). In addition, under s. 286.5 (new), no person shall be prosecuted where the benefit is derived from the provision of their own sexual services.

This is a new offence created by the PCEPA. Under s. 286.4 (new), no person shall be prosecuted in relation to the advertisement of their own sexual services.

Note: One incident may involve multiple violations. Counts are based upon the most serious violation in the incident. Excludes ss. 210 and 211 of the Criminal Code related to bawdy-houses. See Text box 1 for information on the specific violations examined in this article. Bill C-36, the Protection of Communities and Exploited Persons Act (PCEPA) came into force in December, 2014. As such, a small number of incidents under the new laws were reported in that year. In addition, information is presented by the year of reporting: as such, incidents that occurred under the previous legislation (prior to 2015) but that were not reported until 2015 or later are included in the post-PCEPA period. Rates are calculated on the basis of 100,000 population. Populations are based upon July 1st estimates from Statistics Canada, Centre for Demography.
